GENERAL TERMS AND CONDITIONS OF USE AND SALE – CLUBX.NL

These General Terms and Conditions apply between:

IAMONLINE B.V., a private limited liability company registered in the Netherlands under KvK number 96677767, with its registered office at Joop Geesinkweg 901-999, 1114 AB Amsterdam, The Netherlands, hereinafter referred to as "ClubX.nl" or "the Platform";

and any person using the services of ClubX.nl, hereinafter referred to as "the User."

Together referred to as "the Parties."

PREAMBLE

Welcome to ClubX.nl, a live-streaming and digital interaction platform created for adults. ClubX.nl empowers content creators to monetize digital experiences such as private video calls, live shows, and media uploads. All content is independently produced and managed by the Users.

By using ClubX.nl, Users confirm that they understand and fully accept these General Terms and Conditions.

PART I – DEFINITIONS AND GENERAL PROVISIONS

Complaints Procedure

Users may report abusive or rule-violating content. Reports are handled confidentially and processed within 7 days of receipt. Please use our contact page.

Content Removal

We take all requests seriously. If you are the victim of or come across content that you know to be:

  • Non-consensual production and/or distribution of your image;

  • Otherwise abusive and/or illegal content;

  • Content revealing personal information,

please provide the following:

  1. Your legal name (copy of ID, driver’s license or passport);

  2. Relevant URLs;

  3. Details regarding the removal request;

  4. A photo of you holding a handwritten note with today’s date and the word “clubx.nl.”

Non-consensual content will be removed within 24 hours of receipt. Reports remain strictly confidential.

INTERNAL MONITORING POLICY

Purpose

This policy outlines the scope, methods, and purpose of monitoring activities conducted by IAMONLINE B.V. to protect company assets, ensure compliance with applicable laws, and maintain a secure environment.

Scope

Applies to all employees, contractors, consultants, and third parties accessing IAMONLINE B.V. systems, networks, or data.

Types of Monitoring

  • Network: traffic analysis, bandwidth usage, access logs;

  • System: server uptime, CPU, memory, storage;

  • Applications: logs and performance metrics;

  • Email & Communications: company-provided accounts (for security/compliance);

  • Devices: activity on company-issued equipment;

  • Access: login attempts, remote access sessions, file access logs.

Methods
Monitoring is performed via automated tools and manual review, in accordance with legal requirements and with respect for privacy.

Employee Awareness
Employees are informed of this policy during onboarding and via the handbook. Use of company systems constitutes acceptance.

Data Usage & Retention
Collected data is restricted to legitimate business purposes. Retention periods vary depending on data type and law; outdated data is securely deleted.

Violations
Any attempt to interfere with monitoring may result in disciplinary action, including termination.

Review
Reviewed annually and updated as necessary.

ARTICLE 1 – Definitions

  • Platform / Website: The online service offered at https://www.clubx.nl, managed and operated by IAMONLINE B.V.

  • User: Any natural or legal person using ClubX.nl, including Content Creators and Viewers.

  • Content Creator (Creator): A User who shares, broadcasts, or sells adult digital content.

  • Viewer: A User who views, purchases, or interacts with Creator content.

  • Live Session: A real-time streaming event initiated and controlled by a Creator.

  • Account / Profile: A secure User space to access and manage services.

  • Force Majeure: An unforeseeable, irresistible external event preventing fulfillment of obligations.

  • KYC (Know Your Customer): Identity verification required for certain platform features and payouts.

ARTICLE 2 – Purpose and Scope

2.1 These Terms define the rights and obligations of both ClubX.nl and the User.

2.2 Use of the Platform constitutes unconditional acceptance of these Terms.

2.3 ClubX.nl may amend these Terms at any time. Changes are deemed accepted if the User continues to use the platform seven (7) days after notification.

2.4 The User may withdraw consent at any time by deleting their account. Withdrawal applies only to future use.

ARTICLE 3 – User Eligibility and Registration

3.1 Users must be at least 18 years old and legally capable of entering into contracts.

3.2 Registration is mandatory for paid or interactive features; accurate data must be provided.

3.3 Users may only operate one account unless expressly authorized.

3.4 Creators must complete KYC verification.

3.5 Users are responsible for safeguarding their login details.

PART II – SERVICES AND PLATFORM USE

ARTICLE 4 – Description of Services

ClubX.nl provides:

  • Paid live video streaming;

  • Private 1-on-1 sessions;

  • Media uploads (photos/videos);

  • Internal messaging.

The Platform is a neutral intermediary. Access to paid features requires token/credit purchase (non-refundable unless legally required). Purchased content grants a personal, non-transferable license.

ARTICLE 5 – Availability

The Platform is generally available 24/7, except during maintenance or unforeseen issues. Users will be notified of planned downtime where possible. Support: clubx@iamonlinebv.nl (response within 48 hours on business days).

ARTICLE 6 – Payments and Earnings

  • Users purchase tokens/credits (prices shown in EUR/USD, incl. taxes).

  • Payments are processed by third-party providers; no card/bank data stored by ClubX.nl.

  • Creators earn revenue minus commission and fees.

  • Payouts are weekly ifa minimumm threshold (e.g., €50) is met.

  • Creators are responsible for their own taxes.

ARTICLE 7 – Content Policy

Strictly prohibited:

  • Minors or under-18 content;

  • Non-consensual acts;

  • Incest, coercion, bestiality, rape fantasies;

  • Illegal drug use;

  • Extreme violence or blood.

Creators must store valid age/consent records. ClubX.nl may remove content, suspend accounts, and notify authorities if required.

ARTICLE 8 – Code of Conduct

Users must act respectfully. Harassment, hate speech, threats, and spamming are banned. Creators may moderate streams and block disruptive users. Abuse may lead to permanent suspension. Misconduct reports:  clubx@iamonlinebv.nl (reviewed within 7 days).

ARTICLE 9 – Intellectual Property

  • IAMONLINE B.V. owns all software, branding, and platform infrastructure.

  • Creators retain ownership of content but grant ClubX.nl hosting rights.

  • Downloading, recording, or reselling without consent is prohibited.

  • Unauthorized use of branding or scraping may result in legal action.

PART III – LEGAL FRAMEWORK

ARTICLE 10 – Liability

ClubX.nl is a technical provider only and not responsible for:

  • User disputes;

  • Force Majeure events;

  • Technical issues caused by User devices/networks.

Users indemnify ClubX.nl against damages caused by their misuse.

ARTICLE 11 – Data Protection

User data is processed under GDPR and the Privacy policy. Users may access, correct, delete, or export their data. Contact: clubx@iamonlinebv.nl

ARTICLE 12 – Termination

Users may close accounts anytime via settings or by contacting support. ClubX.nl may suspend or ban accounts for violations, prohibited content, or fraud. Data is deleted within 7 days of closure. Refunds only where legally required.

ARTICLE 13 – Governing Law

These Terms are governed exclusively by Dutch law. Disputes shall be resolved before the competent court in Amsterdam, the Netherlands.
